Ponderosa Peachland Development Limited Partnership, Treegroup Ponderosa Development Corp. and 0817642 B.C. Ltd.

 

On June 23, 2014, an Initial Order under the Companies Creditors Arrangement Act was made in the Supreme Court of British Columbia respecting Ponderosa Peachland Development Limited Partnership, Treegroup Ponderosa Development Corp. and 0817642 B.C. Ltd., collectively “Ponderosa”.  Pursuant to that Order. D. Manning & Associates Inc. was appointed as monitor, an officer of the Court (“the Monitor”), to monitor the business and financial affairs of Ponderosa.

On July 22, 2014, a second Order was made by the Court. A copy of the Initial Order and the second Order are reproduced below.  Other pertinent information arising after June 23, 2014 are posted below.

On April 7, 2015, an Order was pronounced by Madam Justice Fitzpatrick which extended the stay period to July 27, 2015 at 11:59pm PDT.  This Order also introduced powers for the Monitor to conduct a Marketing Process as well as addressing funding requirements.  The stay was subsequently extended to December 11, 2015.

On December 11, 2015, an Order was pronounced by Madam Justice Fitzpatrick extending the current stay to March 11, 2016 at 11:59pm.  The Order also addressed funding requirements.

On March 9, 2016, Madam Justice Fitzpatrick  pronounced an Order extending the current stay to June 17, 2016, and ordered additional borrowings.

On June 17, 2016 Madam Justice Fitzpatrick pronounced an Order extending the current Stay of Proceedings to August 19, 2016, and ordered additional borrowings.

On August 19, 2016, Madam Justice Fitzpatrick pronounced an Order extending the current Stay of Proceedings to September 12, 2016.

On September 7, 2016, Madam Justice Fitzpatrick pronounced an Order extending the current Stay of Proceedings to October 17, 2016, and Orders approving the sale of Ponderosa Lands and Drought Lands.

A Termination Order was issued by the Court on October 17, 2016 terminating the CCAA process in this matter.  The relevant Order entered by the Court has been posted, stamped November 7, 2016.  One of the terms of the Order is the discharge of the Monitor.
